Experiencia profesional

José Maria cuenta con una dilatada experiencia y gran reputación , como abogado y asesor jurídico, ha sido letrado en innumerables litigios – en todos los órdenes jurisdiccionales, incluido el militar- concernientes a materias especificas como la Responsabilidad Civil, Derecho de daños, Derecho del seguro, Valoración del Daño, Derecho penal (negligencia, e imprudencia, económico.), Responsabilidad Patrimonial, tanto en representación de personas particulares, como de entidades mercantiles de diversa dedicación, a las que asimismo ha asesorado de modo interno.

Es socio del despacho HERNANDEZ-CARRILLO ABOGADOS, y responsable del Departamento de Responsabilidad Civil y Seguros del mismo.

Ha sido Presidente del Grupo de Abogados de Derecho de Circulación, Responsabilidad civil y Seguros del Ilustre Colegio de Abogados de Granada, durante 15 años.

En lo que respecta a su faceta docente, es profesor en los Cursos I a XV de “Valoración del Daño Corporal”, 2006 a 2020; “Área de Tratamiento Jurídico del Daño”, los años académicos 2001/2002, a 2019/2020, de “Responsabilidad por Negligencia Médica” 2.007, y de “negociación”, y Primera a Séptima Ediciones del Máster Propio en Responsabilidad Civil, organizado por la Fundación de Estudios y Prácticas Jurídicas de Granada (octubre 2013 – junio 2014 y octubre 2019 – mayo 2020) de la Universidad de Granada y el Ilustre Colegio de Abogados de Granada. Asimismo tutor Externo en las Asignaturas Prácticum I y Prácticum II, correspondientes al Plan de Estudios conducente a la obtención del Título de Licenciado en Derecho por la Universidad de Granada. Asimismo fue docente, en el curso de neuropsicología forense del Ilustre Colegio Oficial de Psicólogos de Andalucía Oriental (11, 12, 18 y 19 de Mayo de 2007), en el curso de formación continua (marzo 2016) dirigido a mediadores civiles y mercantiles que lleven a cabo procesos de mediación en controversias derivadas de accidentes de tráfico, de la  Comisión de Mediación del Colegio de Abogados de Granada (Ley 35/2015 de 22 de septiembre).

Fue uno de los cuatro fundadores  de la Asociación Española de Abogados Especializados en Responsabilidad Civil y Seguro (miembro de la organización de sus diecinueve Congresos) Secretario de Actas-Tesorero.

Ha sido miembro de la Pan-European Organisation of Personal Injury Lawyers; Moderador, o ponente en numerosos Simposios, Jornadas y Congresos.

Formación

  • Licenciado en Derecho por la Universidad de Granada (Promoción de 1981-86) Abogado, Colegiado nº2.559, incorporado como ejerciente al Colegio de Abogados de Granada el 30-9-87.
  • Agente y Corredor de Seguros titulado el 5-10-89, con el nº20.042.
  • Mediador Civil, y en Valoración del daño corporal (Ley 35/15, de 22 de septiembre,  de reforma del sistema para la valoración de los daños y perjuicios causados a las personas en accidentes de circulación).
  • Máster en Medicina Forense, para profesionales no Médicos (550 horas) con calificación de sobresaliente. 17-6-1.997.
  • Curso Universitario de Fundamentos de la Valoración Médica del daño Corporal C.F.C. Universidad de Granada, Departamento de Medicina Legal, 19 Junio al 19 Octubre 1.998.
  • Asistente al curso “DERECHO SANITARIO” en mayo, junio de 2007, en la Real Academia de Medicina de Granada.

José Maria has a wide range of legal experience and an excellent reputation as both a lawyer and a legal adviser.   He has been a lawyer in innumerable disputes  in the courts of all the jurisdictions, including the military jurisdiction –  representing clients in disputes related to specific fields such as Civil Liability, Tort Law, Insurance Law,  Evaluation of Injuries, Criminal Law (negligence, recklessness, and economic criminal law)and  State Liability.  He has represented  both individuals and  a wide range of  different commercial entities, for which he has also been an in-house advisor.

He is a partner of the HERNANDEZ-CARRILLO ABOGADOS law firm and is the head of  the department of Civil Liability and Insurance at this firm.

He was the President of the Group of  Road traffic, civil liability, and Insurance Law Lawyers  for 15 years

In the field of education, he has been a professor on the courses I to XV of “Evaluation of Bodily Injury” 2006-2020; “The Field of Legal Treatment of Injuries” from the academic years 2001/2002 to 2019/2020,   “Medical Negligence Liability” 2007, “Negotiation” and the First to Seventh editions of the Master’s Degree in Civil Liability at the Foundation of Legal studies and Legal Practice of Granada  (October 2013 – June 2014 and  October 2020 – May 2020) organised by the University of Granada and the Bar Association of Granada.  He is also an private tutor for  the courses Prácticum I and Prácticum II, which belong to the to the study programme which leads to gaining a bachelor’s degree in Law at the University of Granada.  He was also a teacher on the course of Forensic Neuropsychology for the Official Professional Association of Psychologists of Western Andalucía (11, 12, 18 and 19  May  2007), as well  as on the further education training course (March 2016) for civil  and commercial mediators who carry out  mediation procedures in disputes originating from traffic accidents, for the Mediation Commission of the Bar Association of Granada (Law 35/2015,  22 of  September).

He was one of the four founders of the Spanish Association of Lawyers specialised in Civil Liability and Insurance ( member of the organisational committee of the  nineteen congresses held by this association). Clerk and Treasurer.

He has been a member of the Pan-European Organisation of Personal Injury Lawyers: A moderator and speaker in numerous symposiums, conferences  and congresses.

Education and Training

  • Bachelor’s degree in Law from the University of Granada (1981-1986). He is a lawyer and became a  member of the Bar Association of Granada ( nº2.559) on the 30/09/1987.
  • He became a qualified insurance agent and broker (nº20.042) on the 5/10/1989.
  • Civil Mediator  and a mediator in the Evaluation of Bodily Injury (Law 35/15, 22 September, for the reform of the system for the evaluation of injuries suffered by people in traffic accidents).
  • Master’s degree in Forensic medicine (550 hours) received with distinction.
  • University course in The Fundamentals of the Medical Evaluation of Bodily Injury C.F.C, at the University of Granada, Department of  Legal Medicine 19 June to 19 October. 1998
  • Attended a course on Medical Law in May and June 2007 at the Royal Academy of Medicine, Granada
